The sense of the present gained by the single-year survey is a solid trade-off for the statistical advantages of larger multi-year samples. Claimants arbitrating in 2008 were a fairly exclusive group (897 Awards issued), with Customers generally faring better than disputants earlier in the new millennium, as 2008 saw trend reversals favorable to Customer-claimants. Small Claims (below $25,000) customers also saw outcomes go more their way, although the results throw into relief the perennial 2 x 2 choice (hearing/papers; counsel/pro se) facing the investor in Small Claims disputes. What can the 2008 Customer Awards tell us in the context of the 2000 Tech Crash surge? Differences between the two periods and the present dynamics of the market and its effects on the dispute process and participants suggest emerging Customer trends continuing into 2009. The mixed news for employees in 2008 (dropping win rates vs. steady recovery rates and hefty awards) raises speculation about the direction of Wall Street's employment environment in coming years.
